These terms are a draft and apply subject to formal incorporation of the cooperative. The authoritative legal framework is set out in the statutes.
1. Scope
These terms govern your relationship with Public AI Switzerland when subscribing to cooperative shares and using our services, in particular Apertus.
2. The cooperative
Public AI Switzerland is a cooperative under Art. 828 ff. of the Swiss Code of Obligations. Until formal registration, contributions are held in trust.
3. Share and membership
You join by subscribing to at least two shares of CHF 50.– each (CHF 100.– total). Each member has one vote.
4. Research and development fund
From the second year of membership you contribute at least CHF 50.– per year to the research and development fund.
5. Use of Apertus
Using Apertus is separate from membership. The chat is generally free; the API is billed by usage.
6. Availability and warranty
We strive for reliable operation but cannot guarantee uninterrupted availability.
7. Liability
To the extent permitted by law, we are liable only for damages arising from gross negligence or intent.
8. Intellectual property
Apertus is an open model. The brand, logo and editorial content of Public AI Switzerland are protected.
9. Changes
We may amend these terms and inform members of material changes in good time.
10. Applicable law and jurisdiction
Swiss law applies exclusively. The place of jurisdiction is the seat of the cooperative.
